• Purpose: Outlines terms for purchasing consumer products, handphones and motorcycles via social media platform, SIMPEL and using salary deductions through ANGKASA for Malaysian government employees.
• Agreement: By using the platform or opening an account, users accept these Terms. If not agreed, refrain from using the services.
• Platform Role: SIMPEL acts as a platform for Buyers and Sellers but is not a party to transactions. Buyers and Sellers are fully responsible for their contracts.

2. Privacy

• Data Use: Velocity Direct Sdn Bhd (Velocity Direct) collects and processes users' data per the Privacy Policy. Users agree to the collection, use, and disclosure of personal data.
• Data Protection: Users with access to others' data must comply with personal data protection laws.
• Ownership: Velocity Direct shares proprietary rights over user information.

3. Software

• Velocity Direct retains rights to any software provided as part of the services. Third-party scripts or codes are licensed directly by their owners.

4. Accounts and Security

• Users are responsible for securing their account credentials and notifying Velocity Direct of any unauthorized activity.
• Velocity Direct may suspend or terminate accounts for reasons including inactivity, non-compliance with terms, or fraudulent activities.
• Government employees are the only eligible users for this service.

5. Terms of Use

• Users must not upload illegal, harmful, or infringing content or misuse the platform in any way.
• Users are prohibited from fraudulent behaviour, price manipulation, or unauthorized transactions.
• Velocity Direct may remove content or restrict access for violations.

6. Eligibility

• Available only to Malaysian government employees or government-linked entities supporting ANGKASA salary deductions.
• Applicants must be at least 18 years old and provide valid identification and employment verification.

7. Credit Assessment

• ANGKASA uses the SPeKAR platform for credit evaluation, ensuring responsible lending based on salary deductions and credit history.

8. Debt Service Ratio

• Salary deductions for loans cannot exceed 60% of an employee's monthly income to ensure financial stability.

9. Financing Amount and Tenure

• Up to 100% financing is offered, with repayment terms of 1–5 years.

10. Payment Terms

• Payments are deducted automatically via ANGKASA’s SPGA system.
• Early settlement is available, subject to fees. Financing may comply with Shariah principles.

11. Order and Delivery Process

• Orders for goods shall be placed through SIMPEL as specified by Velocity Direct. Delivery of goods shall occur either before or after the deductions/payments for the goods have been completed, in accordance with the terms agreed upon at the time of purchase.
• Customers are required to provide accurate and complete delivery details when placing an order. Velocity Direct shall not be held liable for any delays, misdeliveries, or other delivery issues arising from the provision of incorrect, incomplete, or inaccurate information by the customer.

12. Seller’s Responsibilities

• Sellers must ensure accurate product listings, pricing, and compliance with all relevant laws and by-laws, regulations and guidelines.
• Sellers are liable for delivery and any disputes arising from the sale.

13. Disputes

• Buyers and Sellers are expected to resolve disputes directly. Velocity Direct facilitates but is not liable for disputes.

14. Ownership and Title

·        Ownership of the motorcycle and all other consumer goods sold shall remain vested in Velocity Direct until the purchaser has made full payment of the purchase price in accordance with the terms of the agreement.

15. No Cancellations or Refunds

• Purchases are final; no cancellations, returns, or refunds are permitted.

16. Warranty and Liability

• Standard manufacturer warranties apply. Velocity Direct is not liable for misuse or modifications.

17. Data Privacy

• Customer data its protected under Malaysia’s Personal Data Protection Act (PDPA) and used for transactions and legal compliance.

18. Customer Obligations

• Customers must inform Velocity Direct of employment or salary changes to avoid defaults and recovery actions.

19. Amendments

• Terms may be updated, with notifications provided through official channels.

20. Governing Law

• Malaysian laws govern these terms, with disputes resolved in Malaysian courts.

21. Liability and Disclaimers

• Velocity Direct is not liable for motorcycle-related claims, encouraging buyers to obtain appropriate insurance.

22. Dispute Resolution

• Disputes are resolved through arbitration per jurisdiction laws.

23. Fraudulent Activity

• Fraudulent activities may result in account suspension, closure, or legal action.

24. Indemnity

• Users indemnify Velocity Direct against claims arising from transactions, misuse of services, or content uploaded.

25. Severability

• If any provision is deemed invalid, it does not affect the validity of the remaining terms.

26. Feedback

• Users can provide feedback to improve services. Anonymous or defamatory feedback will not be considered.
