Return policy

Effective Date: 14 March 2025

Applicable to: All purchases made through the SIMPEL platform and financed by Velocity Direct Sdn Bhd.

1. Introduction

This No Return Policy outlines the terms and conditions under which goods delivered by LINECLEAR, financed by Velocity Direct Sdn Bhd, and purchased through the SIMPEL platform cannot be returned. By making a purchase, the buyer agrees to the terms stated in this policy.

Goods Definition:-

Goods generally refer to tangible, movable property that can be bought and sold. They include:

  • Consumer Goods: Items purchased for personal use, such as handphones, electronics, clothing, and appliances.
  • Durable Goods: Products designed to last a long time, like vehicles, furniture, and machinery.

2. Scope of Policy

This policy applies to:

  • All goods sold via the SIMPEL platform, regardless of the seller advertising the product.
  • Products that are successfully delivered and in working condition as per the order.
  • Buyers who have completed a transaction and accepted delivery of the goods.

This policy does not apply to returns due to defective, damaged, or misrepresented goods, which are covered under Section 7.

3. No Returns for Change of Mind

  • Buyers cannot return goods due to a change of mind, preference, or buyer’s remorse.
  • Once the order is confirmed and delivered, it is considered final and non-refundable.

 

4. No Returns for Incorrect Orders

  • Buyers are responsible for reviewing their order details before confirming a purchase.
  • Velocity Direct Sdn Bhd do not accept returns for incorrect items ordered by mistake.

5. No Returns for Items That Do Not Meet Buyer’s Expectation

  • If the product received is as described in the listing but does not meet the buyer’s personal expectations, a return is not permitted.
  • Buyers must rely on the product description, specifications, and seller-provided images before purchasing.

6. Exceptions: Defective, Damaged, or Misrepresented Goods

Notwithstanding this No Return Policy, Velocity Direct Sdn Bhd will consider cases where:

  • The product is defective, i.e., it does not function as intended.
  • The item is damaged during delivery, with visible evidence such as broken parts.
  • The product is significantly different from the advertised description.

In such cases, the goods only be replaced, and no store credit or cash be given and refunded.

6.1 Reporting Process

If a buyer believes their case falls under this exception:

  • The buyer must report the issue within 7 – 14 days from the date of delivery.
  • Evidence (photos/videos of defects, damage, or discrepancies) must be submitted via the SIMPEL platform.
  • If the issue is validated, only a replacement or repair will be offered. No cash refunds.

7. Compliance with Malaysian Laws

This policy adheres to the Consumer Protection Act 1999 (CPA 1999) and other relevant Malaysian regulations:

  • Fair Trade Compliance: The policy ensures transparency and aligns with Section 10 of the CPA 1999, which prohibits misleading trade descriptions.
  • Non-Return for Buyer’s Remorse: Under Section 64 of CPA 1999, sellers are not obligated to accept returns unless the item is faulty, dangerous, or misleadingly described.
  • Digital Financing & e-Commerce Regulations: Purchases financed by Velocity Direct Sdn Bhd are legally binding, as per Contracts Act 1950, and must be honoured by the buyer.

8. Buyer’s Responsibilities

By completing a purchase:

  • The buyer confirms their acceptance of this No Return Policy.
  • The buyer agrees to carefully inspect the product details before purchasing.
  • The buyer acknowledges that all transactions are final and binding.

9. Amendments & Modifications

Velocity Direct Sdn Bhd reserves the right to amend this policy as necessary, with updates reflected on the SIMPEL platform. Continued use of the platform after amendments constitutes agreement to the revised terms.
