Cancellation policy

Effective Date: 14 March 2025

1. INTRODUCTION

This No Cancellation Policy ("Policy") applies to all purchases made via Simpel ("Platform"), a marketplace operated and financed by Velocity Direct Sdn Bhd ("Company"), which also serves as the Seller of the goods available on the Platform.

The shipping, handling, and delivery of goods are managed by LINECLEAR ("Logistics Partner"). By making a purchase on Simpel, Platform, customers agree to comply with this Policy.

Goods Definition:-

Goods generally refer to tangible, movable property that can be bought and sold. They include:

  • Consumer Goods: Items purchased for personal use, such as handphones, electronics, clothing, and appliances.
  • Durable Goods: Products designed to last a long time, like vehicles, furniture, and machinery

2. NO CANCELLATION POLICY

2.1 Order Finality

Once an order is placed on the Platform and payment is successfully processed, it cannot be cancelled or modified under any circumstances, except as provided in Section 3 (Exceptions).

2.2 Seller and Logistics Confirmation

Orders are automatically processed and forwarded to Velocity Direct Sdn Bhd and the Logistics Partner upon confirmation of payment will make the arrangement for the delivery of the goods. Due to the real-time nature of order processing, cancellation is not possible once an order has been submitted.

2.3 Finality of Transactions

All transactions on the Platform are final confirming the purchase. Cancellation, refunds or reversals will not be entertained due to the automated system in place.

3. EXCEPTIONS

Notwithstanding the above, cancellations may be allowed only under the following limited circumstances:

3.1 Seller Unavailability

  • If Velocity Direct Sdn Bhd, as the Seller, is unable to fulfill the order due to product unavailability or other unforeseen circumstances, the order may be cancelled, and the customer will receive a full refund or a replacement option.

3.2 Logistics Issues

  • If LINECLEAR fails to deliver the goods within the agreed delivery period due to logistics failure (excluding force majeure events), the order may be cancelled and refunded, subject to investigation and discretion of Velocity Direct Sdn Bhd.

3.3 Legal Compliance

  • If an order is deemed fraudulent, violates Malaysian law, or involves restricted/prohibited goods, it may be immediately cancelled by Velocity Direct Sdn Bhd.

4. No Cancellation, No Return and No Refund policy

Velocity Direct Sdn Bhd maintains a strict No Cancellation, No Return, and No Refund policy. All sales order once placed and confirmed via SIMPEL, it is/are deemed as binding and final.

4.1 Exceptions for Defective or Incorrect Products

·      In the rare event that a product is received in a defective or incorrect condition, customers must submit a request for resolution within 7 - 14 days of receipt, providing proof (photos/videos) for verification.

·      Velocity Direct Sdn Bhd’s sole discretion to replace the defective or incorrect condition goods delivered to the customers.

4.2 Resolution Process

  • Velocity Direct Sdn Bhd will assess the issue and, at its sole discretion, may offer a replacement for defective or incorrect items.
  • Returns will not be accepted under any circumstances.
  • Refunds will not be issued, except where legally required.

4.3 Policy on Simpel Purchases

All purchases made through Simpel are strictly non-cancellable, non-returnable, and non-refundable under all circumstances.

 

5. FORCE MAJEURE

Velocity Direct Sdn Bhd and LINECLEAR shall not be held liable for cancellations, delivery failures, or order modifications due to force majeure events, including but not limited to:

  • Natural disasters (floods, earthquakes, fires)
  • Government regulations or restrictions
  • Strikes, pandemics, or supplier failures

6. CUSTOMER RESPONSIBILITIES

  • Customers are advised to review product details, estimated delivery timelines, and Platform policies before placing an order.
  • By proceeding with a purchase, customers acknowledge and accept that cancellations are not allowed, except under the exceptions listed in Section 3.

7. AMENDMENTS TO POLICY

Velocity Direct Sdn Bhd reserves the right to update or modify this Policy at any time without prior notice. Continued use of the Platform after changes constitute acceptance of the revised terms.
